Effective date: June 15th, 2021
We are committed to maintaining your trust in accordance with our Values. Respect begins with an acknowledgement that your Personal Information is yours to control.
This Privacy Policy describes how we, with your consent, collect, use and share your personal information. Together with our Terms of Service, this policy forms the basis of your relationship with ContentGems, our software, products, and services. All capitalized terms have their definition in our Terms of Service, unless otherwise noted here.
Where there are trade-offs between your privacy and technical functionality, we will be as transparent as possible. We want you to know how we make money and how we will remain accountable. There will not be a one-size approach to privacy, and we will work to embed options into the products and services we build. Together, we can establish an engaged and inclusive approach to the collection, use, and disclosure of personal information.
We will update this policy from time to time as technology, privacy laws, and your expectations change. Let’s revitalize privacy to establish meaningful reciprocity, informed by Truth, Love, Respect, and opportunities to tell our own stories.

Much of the distrust relating to privacy practices results from organizations not being transparent about their business models. “Free” products and services tend to monetize personal information itself. Our business generates revenues through:
Services: We are paid through a services relationship to customers to design brand identities, develop websites, build custom software, and manage digital communications.
Products: We develop and maintain digital products, including the Website, and are paid by customers who license these products for use.
We do not sell your Personal Information for monetary or other consideration.
By signing-up through the Website or using the Service, you are consenting to the collection, use, and disclosure of your Personal Information in accordance with this Privacy Policy.
We may update the Privacy Policy at any time. We will notify you of material changes to the Privacy Policy with 30 days’ notice prior to the change taking effect, with the notice posted on the Website or by email to the address associated with your account. Your continued use of the Website or the associated Service following those 30 days constitutes acceptance of the updated policy.
An archive of this policy will remain available for your review.
"Personal Information" is any information about you which could, alone or together with other information, personally identify you or otherwise be reasonably linked or connected with you. Information such as a username and password, an email address, a real name, an Internet protocol (IP) address, and a photograph are examples of your “Personal Information.”
Your Personal Information does not include aggregated, non-personally identifying information that does not identify you or cannot otherwise be reasonably linked or connected with you. We may use such aggregated, non-personally identifying information for performance analytics purposes and to operate, analyze, improve, and optimize the Website and the Service.
Account Information: We require some basic information at the time of account creation. When you create your own username and password, we ask you for a valid email address.
Your Content: Through your ongoing use of the Service, you may upload Personal Information such as documents, photographs, video, and audio of yourself.
Payment Information: If you create a paid account to access the Website or use the Service, we collect your name, address, and credit card information. We do not process or store your credit card information, but our third-party payment processor does.
Usage Information: With your consent, we automatically collect the same basic information that most services collect. This includes information about how you use the Service, such as the pages you view, the referring site, your IP address and session information, and the date and time of each request. This is information we collect from every visitor to the Website, whether they have an account or not. This information may include User Personal information.
Cookies: We automatically collect information from cookies (described below) to keep you logged in, to remember your preferences, to identify you and your device and to analyze your use of our service.
Device Information: We may collect certain information about your hardware or network connection, such as its IP address, browser, language preference, operating system and application version, device type and ID, and device model and manufacturer. This information may include User Personal information.
We may collect information about you through third parties, whether through authentication information, such as a single sign-on, or through your integration of an application programming interface (“API”). We will not solicit or purchase your Personal Information from third parties.
We do not knowingly collect information on children under 13. If we learn or have reason to suspect that you are under the age of 13, we will have to close your account.
We do not intentionally collect “Sensitive Personal Information”, such as personal data revealing racial or ethnic origin, heritage, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation, or financial information. Our customers may configure certain Services to collect Sensitive Personal Information on their own account. We recommend that you do not upload Sensitive Personal Information to the Website or the associated Service. If you choose to store any Sensitive Personal Information on our servers, you do so at your own risk and you are responsible for complying with any regulatory controls regarding that data. Consider that our security practices are not designed to protect Sensitive Personal Information.
We may use your Personal Information for the following purposes:
For uses not described above, we will describe the additional purposes and ask for your additional consent before using your Personal Information.
We may disclose your Personal Information with third parties with your consent. Your consent requires that we notify you what information is being shared, with whom, and why. For example, you may consent to your name and email address being shared with a third-party website for you to authenticate two different accounts with the same login credentials.
We may disclose your Personal Information to our service providers to operate the Website and the associated Service. For example, we rely on third party hosting infrastructure, web-based project management tools, and credit card payment processing. Where your Personal Information is shared with service providers, we require that they enter into contractual privacy restrictions or data protection agreements substantially similar to those established by this Privacy Policy.
We may disclose your Personal Information in accordance with applicable laws and court orders. Where permitted by law, we will notify you of any legally compelled or required disclosure. We may also share your Personal Information in the context of an emergency, as requested by a public authority, if in our judgment it appears that there is an imminent danger to an individual or group and that a court order will not be practical in the circumstances.
We may disclose your Personal Information in association with a business transaction, such as a merger, acquisition by another company, or sale of all or a portion of our assets. In that case, your Personal Information may be included within the assets transferred.
We may de-identify your Personal Information and aggregate this data with other users, at which point it will no longer qualify as Personal Information if it cannot be re-identified. Anonymized data is used for research and development purposes. It may be disclosed to service providers and other third-parties without your additional consent.
We believe in the right of individuals to access or modify their personal information. If you are a registered user of the Service, you may access or update your basic user information within your registered account. If you are not a registered user, please contact our technical support team to access your Personal Information.
We are under no obligation to retain your data. Generally, we will maintain your Personal Information for as long as your account is active or you are using the Service.
You are entitled to request erasure of all your Personal Information held within the Website and the associated Service. Our deletion of Personal Information, whether for an individual or an Indigenous group, will remain subject to our requirements to meet legal obligations, resolve disputes, and enforce our agreements. Where your Personal Information is contained within another user’s account, we will be unable to permanently erase the data.
Cookies are small files that websites often store on computer hard drives or mobile devices of visitors. We use cookies solely to provide, secure, and improve our service. For example, we use them to keep you logged in, remember your preferences, identify your device for security purposes, analyze your use of our service, compile statistical reports, and provide information for future development of the Website.
By using our service, you agree that we can place these types of cookies on your computer or device. If you disable your browser or device’s ability to accept these cookies, you will not be able to log in or use our service.
There is no privacy without security. We apply industry-standard administrative, physical, and technical controls to secure your personal information. Our technical security measures are based on the types of Personal Information held on behalf of our users (excluding Sensitive Personal Information) and are appropriate for the nature, size, and complexity of our operations.
Transmission of your Personal Information is encrypted in transit (TLS). As part of our anti-phishing and identity theft prevention efforts, we will never request your credit card information through unsecure channels, including email or by phone.
No computing or network technology is 100% secure and we do not guarantee the absolute security of the Service. In the event of a data breach that affects your Personal Information, we will act promptly to mitigate the impact of a breach and notify you without undue delay.
